Hasan Fayez appointed Chief Justice, notification issued

Justice Hasan Fayez Siddiqui of the Appellate Division has been appointed as the 23rd Chief Justice of the country.

According to the power of Article 95 (1) of the Constitution. Abdul Hamid Hassan Fayez Siddiqui has been appointed as the Chief Justice by the Law and Justice Department of the Ministry of Law, Justice and Parliamentary Affairs on Thursday (December 30th).

The appointment will be effective from the date of taking oath, the notification said. Hasan Fayez Siddiqui will retire on September 25, 2023.

Former Chief Justice Syed Mahmud Hossain turns 6 years old on December 31. As such, the 22nd Chief Justice is retiring on the last day of the year. As 31st December is Friday, 30th December (Thursday) is his last working day. Following the retirement of Syed Mahmud Hossain, the President appointed Hasan Fayez Siddiqui to the post of Chief Justice.

According to Article 95 of the Constitution, the President appoints the Chief Justice. Article 95 (1) of the Constitution states, “The Chief Justice shall be appointed by the President and the President shall appoint other judges in consultation with the Chief Justice.”

An official of Bangabhaban told the media that Justice Hasan Fayez Siddiqui will take oath from the President at Bangabhaban on Friday afternoon (December 31).

Incidentally, Hasan Fayez Siddiqui was born on 26 September 1956. He was enrolled as a lawyer in the Dhaka Judge’s Court in 1981 and joined the High Court Division in 1983 and the Appellate Division in 1999. He later became a permanent judge of the High Court Division in 2009 and a judge of the Appellate Division in 2013. Besides, this judge has been serving as the chairman of Bangladesh Judicial Service Commission since 2015.

Abu Bakar Siddiqui, the elder brother of Hasan Fayez Siddiqui, was at one time a judge of the Appellate Division.

At present, out of the five judges in the Appellate Division, four will remain when Justice Syed Mahmud Hossain retires. They are- Justice Iman Ali, Justice Hasan Fayez Siddiqui, Justice Md. Nuruzzaman Nani and Justice Obaidul Hasan.

According to Supreme Court sources, the current judges of the Appellate Division include Justice Muhammad Iman Ali on 31 December 2022, Justice Hasan Fayez Siddiqui on 25 September 2023, Justice Md. Nuruzzaman will retire on June 30, 2023 and Justice Obaidul Hasan will retire on January 10, 2026.

The post of Chief Justice was vacant for almost three months after the resignation of Chief Justice Surendra Kumar Sinha on November 10, 2016. At the time, on the basis of seniority, Justice was performing routine duties. Abdul Wahhab Miah.
